This Disclaimer applies to all SIMS software and services (“SIMS”) provided by Bold Technologies Ltd., d/b/a Bold Group (“Bold Group”). All users of SIMS (“Users”) agree to these terms by accessing or using SIMS. Bold Group may update this Disclaimer at any time without notice to Users and the updated terms will apply as of the updated date, continued use of SIMS after the update will be deemed acceptance of the updated terms. If a User does not agree to these terms, such User’s exclusive remedy is to cease accessing or using SIMS.

SIMS is provided “AS-IS” and “AS AVAILABLE.” By accessing or using SIMS, Users assume all risk of using SIMS. Bold Group does not warrant that SIMS will be error-free or uninterrupted or that SIMS will meet a User’s requirements or expectations. Bold Group will not be responsible for any issues related to the performance, operations or security of SIMS. Bold Group expressly disclaims (to the greatest extent permissible under applicable law) all other warranties express, implied, statutory or otherwise, relating to SIMS, including without limitation, any warranties of merchantability, title or fitness for a particular purpose.

In no event will Bold Group or its affiliates be liable for any direct, indirect, consequential, incidental, special, punitive or exemplary damages of any kind or nature arising out of the use of SIMS, including without limitation any loss of revenue, profits, sales, data, data use, good will, or reputation. Bold Group or its affiliates’ maximum liability arising out of or relating to SIMS will be limited to $100.00, regardless of the legal theory on which a claim is brought, even if Bold Group has been notified of the possibility of damage or if such damage could have been reasonably foreseen.
