Court of Appeals Affirms Dismissal of Lawsuit against Bold Technologies
Colorado Springs, CO - February 13,2014. Bold Technologies is pleased that the dismissal of the lawsuit brought against them more than two years ago by Michigan-based Dice Corporation has now been affirmed after appeal. In August of 2011, Dice filed charges against Bold Technologies in federal District Court in Michigan, claiming that Bold Technologies committed several intellectual property violations when converting one of Dice’s former customers to the Manitou software platform. Bold Technologies denied all of Dice’s allegations. Federal District Court Judge Ludington dismissed all of Dice’s claims in a 40-page opinion, finding that “Plaintiff’s assertions lack merit.” Following that outcome, Dice filed a Motion for Reconsideration which was dismissed by Judge Ludington for lack of merit. Dice ultimately appealed the dismissal to the United States Court of Appeals for the Sixth Circuit. On January 24, 2014, a three judge panel of the federal Court of Appeals issued its 18-page opinion, affirming the dismissal of Dice’s case on all counts, agreeing that no evidence existed to support any of Dice’s claims.
Attorney R. Christopher Cataldo of the Southfield, Michigan law firm of Jaffe, Raitt, Heuer & Weiss, PC, defended the case on behalf of Bold Technologies in the federal District Court and on Appeal before the Sixth Circuit. Attorney Cataldo states, “The federal District Court and the federal Court of Appeals carefully reviewed Dice’s claims and agreed with us that Bold Technologies had done nothing wrong and that these allegations were totally groundless. This case never should have been filed and we are thrilled with this result.”
